REGULATIONS OF ELECTRONIC SERVICES
(hereinafter referred to as the “Regulations”)
1. GENERAL PROVISIONS
1.1. These Regulations govern the rights and obligations relating to the use by Users of the Fahrel System website available at https://fahrel.com .
1.2. The Fahrel System website (hereinafter referred to as the “Website”) is available at www. fahrel.com and is run by Seth Software sp. z o.o. based in (36-060) Głogów Małopolski, ul. Strefowa 1 entered in the Register of Entrepreneurs kept by the District Court in Rzeszów, 12th Economic Division of the National Court Register under KRS number 0000114098, REGON (Business ID): 690512599, NIP (Tax ID): 8132709001. Correspondence address: Seth Software sp. z o.o. (36-060) Głogów Małopolski, ul. Strefowa 1.
1.3. You can contact the Website by email at info@fahrel.com and by telephone at + 48 17 784 22 22. The telephone call charge is equal to the charge for a normal telephone call as per the rates of the respective service provider.
2. DEFINITIONS
The following terms used in the Regulations shall have the following meaning:
2.1. Service Provider – Seth Software Sp. z o.o. based in (36-060) Głogów Małopolski, ul. Strefowa 1 entered in the Register of Entrepreneurs kept by the District Court in Rzeszów, 12th Economic Division of the National Court Register under KRS number 0000114098, REGON (Business ID): 690512599, NIP (Tax ID): 8132709001. Correspondence address: Seth Software Sp. z o.o. (36-060) Głogów Małopolski, ul. Strefowa 1.
2.2. Contact Form – an electronic service, an interactive form available in a Website tab enabling contact with the Service Provider.
2.3. “Make an appointment for a presentation” Contact Form – an electronic service, an interactive form available in Website tabs to allow you to contact the Service Provider in order to make an appointment through the Teams application and to present you with a Live Demo presentation on the services and products offered by the Service Provider.
2.4. “Contact us” Contact Form – an electronic service, an interactive form available in the Website tabs to allow you to contact the Service Provider for purposes other than making an appointment with the Service Provider.
2.5. User/You – a person using a Contact Form to the extent provided for in these Regulations, conducting business (entrepreneur), being a legal person or an organisational unit to which legal capacity is granted by law, being a service recipient as defined in the Polish Act on Electronic Services. The form is not intended for consumers.
2.6. Maintenance Break – a temporary shutdown of the Website’s functionality in whole or in part, related to the failure of the Website, including the Website servers, or to the need to maintain these servers or to upgrade or rebuild the Website, during which it is not possible to use all or selected Services.
2.7. Force Majeure – an external event which the User and the Service Provider could not have foreseen and prevented, preventing the use of the Website in whole or in part, either permanently or for a certain period of time, which the User or the Service Provider could not have counteracted with due diligence and which was not the result of errors or negligence on the part of the affected User or the Service Provider.
2.8. Electronic Service – a service provided by electronic means by the Service Provider to the Service Recipient via the Website, i.e. the “Make an appointment for a presentation” Contact Form electronic service and the “Contact us” Contact Form electronic service.
3. TERMS OF USE OF THE WEBSITE
3.1. Access to the “Make an appointment for a presentation” Contact Form electronic service and the “Contact us” Contact Form electronic service is free of charge and does not require any formalities from you, in particular registration and login.
3.2. The necessary minimum technical conditions to be met to be able to work with the ICT system used by the Website include the following: (1) a computer, laptop or any other multimedia device with access to the Internet; (2) access to electronic mail; (3) a web browser: Mozilla Firefox version 17.0 and higher or Internet Explorer version 10.0 and higher, Opera version 12.0 and higher, Google Chrome version 23.0. and higher, Safari version 5.0 and higher. The Service Provider shall not be held liable for any problems arising from the use of devices or operating systems which do not meet the requirements described in this section, in particular for the resulting malfunction of the Website.
3.3. When using the “Make an appointment for a presentation” Contact Form and the “Contact us” Contact Form, short textual information, known as cookies is stored on your device. Some cookies are necessary for the proper provision of electronic services. For more information on cookies, please visit https://fahrel.com.
3.4. By using the “Make an appointment for a presentation” and “Contact us” Contact Forms, you perform the following actions:
3.4.1. filling in the Contact Form by providing data such as the entrepreneur’s business name, the entrepreneur’s first name and surname, telephone number and e-mail address;
3.4.2. confirming your wish to contact us and sending a message by clicking link in the “send” Contact Form.
3.4.3. After clicking the “send” link, the Service Provider will contact you by telephone or e-mail at the telephone number or e-mail address provided in the Contact Form.
3.5. You are required to use the “Make an appointment for a presentation” and “Contact us” Contact Forms in accordance with the provisions of the law, these Regulations and best practices. Use with an intention of violating generally applicable laws or to the detriment of third parties is not permitted. You are also not allowed to provide unlawful content.
3.6. These Regulations form an integral part of an electronic services agreement as defined by the Act of 18 July 2002 on Electronic Services. You will conclude an agreement when you start using a Contact Form.
3.7. You may terminate the use of the service (terminate the electronic services agreement ) at any time without legal consequences, in particular by leaving the website containing a Contact Form.
3.8. You may lodge a complaint concerning the service based on your electronic services agreement. The complaint should include the following:
(i) a description of the event to which it relates,
(ii) a statement of the objection,
(iii) a clear statement of the claim (i.e. what is requested of the Service Provider),
(iv) your contact details and data enabling your identification, in particular your e-mail address where you provided it for the service to which the objection relates.
The Service Provider will consider the complaint within 30 days of receipt and shall respond in writing, including by registered letter and, upon your request, by e-mail. A response to the complaint will be provided within 30 days of receipt. In more complicated cases, the Service Provider will notify you in the form provided for the response that the response will be sent within a maximum of 60 days. If your complaint is accepted, the claim formulated in the complaint will be satisfied within no more than 30 days from the date on which the response to the complaint is prepared.
The Service Provider will make every effort to ensure that access via the Website is possible 24 hours a day and 7 days a week; this does not exclude the Service Provider’s right to order a Maintenance Break and temporarily limit or exclude all or part of the above access.
Where it is necessary to order a Maintenance Break, the Service Provider will announce the expected date and duration of the Maintenance Break in a message displayed directly on the Website.
The Service Provider will not bear liability for the following:
disruptions, including interruptions in the operation of the Website, caused by force majeure, technical interruptions, unauthorised acts of third parties or incompatibility of the Website with the User’s technical infrastructure,
damage caused by the cessation of electronic services unless the Service Provider can be held culpable for the cessation of these services,
damage caused to third parties as a result of the User’s use of services in breach of the Regulations,
the User providing incomplete, erroneous or false personal data,
and the User’s actions in breach of these Regulations.
4. PERSONAL DATA PROCESSING
4.1. When Users use the Contact Form, the Service Provider may collect and process their personal data.
4.2. The notice on data processing by the Service Provider required under Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as the GDPR) is provided in this Privacy Policy.
4.3. The Service Provider will process your personal data in accordance with the relevant legal provisions in force, in particular the GDPR and the Act on Electronic Services.
4.4. The Controller of Users’ Personal Data is the provider of the Contact Form, i.e. Seth Software sp. z o.o. based in Głogów Małopolski.
5. FINAL PROVISIONS
5.1. You are not permitted to provide unlawful content.
5.2. In matters not regulated by these Regulations, Polish law applies.
5.3. In the event of any amendments to these Regulations, the Service Provider will inform the Users on the website at fahrel.com by publishing the new Regulations. The amended Regulations will take effect on the date indicated in the amendment, not less than 14 days from the date of its announcement by the Service Provider, where technical and informative changes that do not deteriorate the situation of the Users may take place within a shorter period.
5.4. The Regulations take effect as of 1 September 2023.
